Line’s unused KBs will pass to other sharing Lines that have exceeded their data allowance, during the same monthly bill cycle. Unused
KBs will be distributed proportionally as a ratio of the KBs needed by each applicable M2M Line to the total KBs needed by all sharing M2M
Lines. Some accounts may require special handling, which may take 1 to 2 bill cycles, before sharing is available. Plan changes may not
take effect until the billing cycle following the change request.

VOIP2320 Customer Account Terms and Conditions:

VOIP2320 is an interactive online service provider for access onto the Internet. This agreement sets forth the Account Terms and Conditions that apply to the subscriber for use of VOIP2320. The subscriber is deemed to have agreed to comply with all terms by use of the service.

 

Statement of Responsibility for Mobile Broadband Service (Applies to mobile broadband accounts only)

 

I agree to the following conditions regarding use of mobile broadband service:

 

I understand I am responsible for the choice of service and am bound to remit payment.

I understand my accounts remain open until I submit a written cancel request and VOIP2320 agrees to close the account. I agree to pay the monthly service fee for each month my account is open and for any months in a term contract for the period I agreed to that have not been paid for whether used or not.  I understand VOIP2320 does not prorate the final month of service.

I understand that VOIP2320 reserves the right to suspend my account at any time if the account becomes past due. I further understand that I will be charged a $25.00 re-activation fee if I do not bring my account current within 5 business days of the suspension. I will continue to be responsible for any outstanding contract for the monthly service fee even if the account is suspended and if my account is suspended more than 3 times in any 6 month period VOIP2320 reserves the right to terminate my account.

I understand that it is my responsibility to provide VOIP2320 a current phone number and email address that I check regularly and to notify VOIP2320 of any changes to my email address or phone number.

I understand that I have 24 hours from receipt of the device to test it to be sure it works to my satisfaction. If, for any reason, I wish to cancel and receive a refund I will contact VOIP2320 by phone or email to make arrangements for mailing back the equipment no later than 24 hrs from date of receipt. After that time no refund will be possible.

If I have not purchased the equipment I understand I am responsible for returning the equipment upon termination of account to the address below. This includes the device, any cords, and the installation CD in proper working order and the original case. I understand my account remain open until the calendar month the device and the entire contents of the original case, including the case, is received by VOIP2320 at 9227 E. Lincoln Avenue, #200 Suite 505, Lone Tree, CO 80124. If it is impossible to return the device and the contents of the case I will pay the current equipment cost on the website and no longer be held responsible for the account.

I understand it is my responsibility to turn off any roaming ability when I take this device outside the US or near its borders.

International Rates: Use of our service outside the US and Puerto Rico will accrue extremely high roaming charges which will automatically be applied to the users system of payment. Use of mobile broadband service near International borders may inadvertently connect to towers located outside the United States.

 

VOIP2320 customers are to exclusively use the technical support and customer service options provided by VOIP2320 for any service or product provided by VOIP2320.

 

We reserve the right to deny, terminate, disconnect, modify or suspend wireless data Service if a Wireless Data device engages in the following prohibited uses: public wifi, broadcast to multi-dwelling units or extraordinary usage such as server devices or host computer applications, including, but not limited to, disproportionate Web camera posts or broadcasts, automatic data feeds, automated machine-to-machine connections, peer-to-peer (P2P) file-sharing applications broadcast to servers or recipients such that they could enable “bots” or similar routines. For All Accounts: Usage of 1 gigabytes over your allowed usage in one month will alert our investigative team to review the account.

 

Coverage isn’t available everywhere. Coverage and Service speeds are not guaranteed. Coverage is subject to change without notice. Service speeds may depend on the Service Location. Actual speeds will vary. Estimating wireless coverage, signal strength, and Service speed is not an exact science. There are gaps in coverage within the estimated coverage areas that – along with other factors both within and beyond our control (network issues, congestion, software, signal strength, personal equipment, structures, buildings, weather, geography, topography, server speeds of the websites you access, actions of third parties, etc.) – may result in dropped or blocked connections, slower speeds, or otherwise impact the quality of Service.

 

Billing Period: All services provided by VOIP2320 will be billed in advance for the upcoming month. Credit card authorized payment will also be billed in the same manner. VOIP2320 reserves the right to terminate or discontinue service at any time.

 

Returned Checks: A returned check charge of $30.00 will be incurred for all returned checks.

 

It is understood that all billings are due on the date of the invoice, and it is agreed that all charges not paid within 10 days of the invoice date are subject to a $3.00 finance charge. When an account becomes more than 90 days past due it may be sent to our collection company for further collection action. In that event a finance charge of 1½ % per month (18% per annum) or the maximum allowed by law will be added to the account each month that the account continues to have a past due balance. In the event that any litigation is instituted for the collection of the above account or debt incurred, it is agreed by entering into this agreement that all but not limited to collection and court costs will be paid, including reasonable attorney’s fees / collection fees. By accepting the terms and conditions above certifies that the foregoing is a transaction, and waives its’ rights to a notice and hearing for a pre-judgment remedy.

 

Billing Disputes: All billing disputes, with VOIP2320, must be received at our business office in writing, and the obligation to pay for service will continue until such notice is received. Termination of your service does not constitute relief from amounts incurred prior to termination. Agreements or contracts with the subscriber, the subscriber agrees to be bound by the agreements or contracts and will be obligated to pay any and all monthly fees in the agreements or contracts.

 

Mobile Broadband Equipment Issues: The client is responsible to alert our technical support team in a timely manner in the event there are issues with the equipment provided. Until such contact takes place VOIP2320 cannot be held responsible for service or product concerns. It is important the client document date, time and the technician spoken with, client should escalate unsatisfactory results to support@VOIP2320.com

 

Return Policy for Mobile Broadband Accounts: Customers who return their equipment immediately upon receiving it (within 24-hours) will be refunded the entire amount of their initial charges except for the shipping fee. Customers who have been told by VOIP2320 that their location is outside the service area and insist we move forward with their order anyway will also forfeit the activation fee.

 

Device Exchanges: If, after working with VOIP2320’s Technical Support department, it is recommended that a replacement device is necessary I understand that I will be required to return the malfunctioning device along with all parts and accessories to the VOIP2320 shipping office at 9227 E. Lincoln Avenue, #200 Suite 505, Lone Tree, CO 80124 within 2 days of receiving the replacement. You must request a tracking or confirmation number from your shipping agent and promptly email that number to billing@VOIP2320.com.

 

In the event we find that your device does not have a factory defect (whether it operates properly or that the discovered defect was operator caused such as water damage, abuse, etc.) you agree to be charged the current cost of the device on our website for the replacement device as well as $19.99 for activation and $15.00 for shipping and we will mail you back your device.

 

If we have not received a tracking number from you within 2 days of the delivery of your replacement you agree to have your credit/debit card charged the total cost for the replacement.

 

Cancellation Policy for Mobile Broadband Accounts: The account will be considered closed during the calendar month the device returned in proper working order in its original case with the original contents to VOIP2320 at 9227 E. Lincoln Avenue #200 Suite 280, Lone Tree, CO 80124. Monthly service payment is required in entirety for the calendar month the device is received. Failure to return the device upon cancellation will result in a charge for the total cost of the device as noted on the website. Client must also use the cancel account support ticket system at https://www.voip2320.com/index-4.html

or email billing@VOIP2320.com or send a letter via US Mail with contact information informing us of the desire to cancel. All cancellations must

be made via Support Ticket or e-mail or the postal service so we can have exact record of the date and specific request of the customer.

 

Cancellation Policy (Customer owned device or Non-Mobile Broadband) Accounts: The account will be billed to the end of the present month. Cancellation requests must be received by the last day of the month in order to be cancelled for the next month. Any cancellation requests received on the 1st or after the 1st will be billed to the end of that month. Agreements or contracts: There is no refund. All cancellations must be made via e-mail or the postal service so we can have exact record of the date and specific request of the customer.

 

Legality of Content: The subscriber agrees to use VOIP2320 for lawful purposes only. The subscriber will not post or transmit any material, through VOIP2320, which violates or infringes upon the rights of other users. This includes, but is not limited to: threatening, abusive, defamatory, vulgar or obscene language, any action which threatens public or private rights or which is considered objectionable, any action which encourages a criminal offense, any action which gives rise to civil liability or violates any law. Attempts to gain unauthorized access to outside computer systems are expressly prohibited. Users agree to abide by any and all rules of the network they access through VOIP2320. The subscriber agrees to defend and hold harmless VOIP2320, its directors,officers, employees, agents or affiliates for all damages and claims that might arise from the subscribers use or misuse of the service, which damages or otherwise harms either the subscriber, VOIP2320 or a third party.

 

Responsibilities: VOIP2320 makes no warranties, expressed or implied, regarding services provided. VOIP2320 is not responsible for any damages suffered from the use of our services, including but not limited to, loss of data, service interruptions and/or delays, or third party litigation.

 

Content Screening: VOIP2320 cannot and does not control the content of information available over the Internet. For this reason, the subscriber certifies that he/she is at least 18 years of age or, if the subscriber is a parent or guardian, he/she assumes all responsibility for supervising the on-line activities of the underage user. Any information garnered through VOIP2320 is done so at your own risk.

 

Unauthorized Connections: The subscriber shall not allow unauthorized connections to VOIP2320, unauthorized reselling of VOIP2320, or the solicitation of VOIP2320 users to become subscribers to other online service providers in competition with VOIP2320, nor shall the subscriber make any unauthorized copies or duplications of any VOIP2320 material, advertising, forms, brochures, pamphlets and the like which is the property of VOIP2320.

 

Relationship: The relationship between the subscriber and VOIP2320 is that of subscriber and service provider only. In the event of a violation of any terms and/or conditions set forth in this agreement, VOIP2320 reserves the right to immediately terminate the services provided to the subscriber.

 

Court Venue: In the event of a dispute, VOIP2320 and the subscriber agree that the venue for such litigation shall be Lone Tree, Colorado and that the terms and conditions of this agreement shall be interpreted under the laws of the State of Colorado.

 

SPAM Policy: The transmission of any type of material, whether graphical or textual in content, to other subscribers or non-subscribers without their express consent is prohibited under the terms of this agreement. Any violations of our SPAM policy will result in immediate termination. Any complaints received from our subscribers or non-subscribers of unsolicited materials will result in a charge of $250.00 per complaint charged to the offending subscribers account automatically.

 

Policy Clarification:

 

VOIP2320 provides 24-hour technical support for issues directly related to our Internet connection. It is required the client respectfully follow the instructions of the technician. Failure to do so revokes the liability of VOIP2320 to provide technical support or credit loss of service.

 

In the event there is a request that a device be replaced, it is necessary that the original device be returned to VOIP2320 9227 E. Lincoln Avenue, #200 Suite 505, Lone Tree,  CO 80124. If a device is replaced and it is later determined by VOIP2320 personnel that the original device was not defective, it may be required the client be charged for the second device and the original device will be returned to the client.

 

There will not be more than one (1) attempt at replacing a mobile broadband device. If the replaced device fails to resolve the connection concern and the original device was within 1-year of purchase, VOIP2320 will refund the original purchase after the failed device is returned to VOIP2320 9227 E. Lincoln Avenue, #200 Suite 505, Lone Tree, CO 80124 and determined by VOIP2320 personnel to have a manufacture defect.

 

Usage:

 

Subscriber is responsible for remaining under the usage cap for their VOIP2320 plan. Subscriber can request their usage total once a week by emailing billing@VOIP2320.com.

 

VOIP2320 reserves the right to suspend an account if the subscriber goes over their usage cap regardless of the remaining days left in the billing cycle. Service will resume at the beginning of the new month. Repeated high usage will result in account termination.
